At PenguinkTransfers, we value creativity and are committed to respecting intellectual property rights. Our platform allows users to upload their own designs and have them printed using high-quality DTF technology—whether for personal use or commercial projects.

These Terms of Service outline the rules and expectations for using our Services, as well as your responsibilities as a user—especially regarding copyright compliance, intellectual property ownership, and proper product usage. By accessing or using Penguink Transfers’ Services, you agree to abide by these terms.

User Responsibilities

Content Ownership

By uploading any artwork, images, or designs to Penguink Transfers, you confirm that you either:

- Own the full rights to the content, or

- Have obtained explicit permission from the original copyright holder to use the content for printing and reproduction.

Indemnification

You agree to indemnify and hold harmless Penguink Transfers and its affiliates from any claims, damages, or legal actions that arise from content you submit or upload, including (but not limited to) intellectual property disputes.

Prohibited Content

You are strictly prohibited from uploading any content that:

- Infringes on copyrights, trademarks, or any other intellectual property rights

- Is illegal, threatening, defamatory, obscene, hateful, or otherwise inappropriate

- Promotes violence, discrimination, or any unlawful activity

Violations of these terms may result in the suspension or termination of your access to Penguink Transfers Services without notice.

Intellectual Property

Respect for Rights

PenguinkTransfers respects the intellectual property rights of others and expects all users to uphold the same standards. You may not upload or submit content that infringes on copyrights, trademarks, or any other protected materials.

Infringement Claims

If we receive a complaint or claim that any uploaded content violates another party’s intellectual property rights, PenguinkTransfers will investigate the matter and may remove the infringing content without prior notice. Repeat violations may result in account suspension or termination.

Limitation of Liability

Penguink Transfers shall not be held liable for any indirect, incidental, consequential, or special damages, including but not limited to:

- Loss of business

- Lost profits

- Loss of goodwill

- Damages arising from the use, misuse, or inability to use our products

Our responsibility is strictly limited to the value of the original order placed directly with Penguink Transfers. We do not accept liability for any costs, damages, or claims arising from third parties, end customers, or the resale of our products.

All products are custom-made, and proper application depends on the user’s equipment, materials, and methods. It is the customer’s responsibility to ensure correct pressing settings, garment compatibility, and care instructions are followed. PenguinkTransfers does not warrant or guarantee results when products are used outside of our recommended guidelines.

By purchasing from us, you agree that any claims must be made directly by the original purchaser within 7 days of delivery, with clear photo or video evidence of the defect. Claims made beyond this period, or by third parties, will not be honored.

Policy Updates

PenguinkTransfers reserves the right to update or modify these Terms of Service at any time. In the event of significant changes, we will notify users through our website or by email.
